GENERAL TERMS AND CONDITIONS ROOM BOOKINGS
1. SCOPE OF APPLICATION
These General Terms and Conditions for Room Bookings (“GTC”) apply to the rental of B&B rooms for accommodation, as well as all other services and deliveries provided by B&B the Jad in this context.
The general terms and conditions of the contractual partner of the Jad shall not apply.
The General Terms and Conditions are also provided in German and French. In case of any discrepancies, the German version shall prevail.
2. CONCLUSION OF THE CONTRACT
The contract is concluded by submitting a room guarantee after B&B the Jad has confirmed that the room is available at the selected time.
The following are considered as guarantees for a room reservation:
– Credit cards, which are accepted as means of payment on our website.
– Advance payment, e.g. by bank or postal transfer.
3. SERVICES AND PRICES
The guest is obligated to pay the prices of B&B the Jad that apply or have been agreed upon for the provision of the room and the other services used by the guest. This also applies to services and expenses of B&B the Jad to third parties arranged by the client.
The prices are in CHF, per room / night, including free W-LAN and breakfast, parking and VAT. The City Tax per person / night is not included but will be paid by the Jad for bookings up to 10 nights.
4. ROOM HANDOVER AND RETURN
Booked rooms are available from 3:00 pm on the agreed day of arrival. There is no entitlement to earlier room check-in. Early check-in and late check-out are available upon request.
On the agreed departure day, the rooms must be vacated and made available to B&B the Jad by 11:00 a.m. at the latest, unless otherwise agreed. In case of late return of the room, a handling fee of 30.– per hour or part thereof and per room will be owed.
5. PAYMENT
Invoices of B&B the Jad without due date are payable within 5 days from receipt of the invoice without deduction. B&B the Jad is entitled to call in accrued debts at any time and demand immediate payment.
B&B the Jad is entitled to demand a reasonable advance payment or security deposit upon conclusion of the contract or thereafter. The amount of the advance payment and the payment dates will be announced with the offer. As a rule, it is a deposit of CHF 300.00.
If the customer is resident abroad, B&B the Jad reserves the right to debit the entire invoice amount from the guarantee credit card. Any exchange rate differences or bank charges shall be borne by the customer.
The client may only offset an undisputed or legally binding claim against a claim of B&B the Jad.
6. CANCELLATION CONDITIONS
Reservations are considered definite when the offer of B&B the Jad has been confirmed. In case of cancellation at short notice after the cancellation deadlines, one or more nights(s) may be charged at 100%.
The following conditions apply:
– Cancellation up to 7 days before arrival date: no charge.
– Cancellation up to 4 days before arrival date: The cost of at least 2 nights, if at least 2 nights have been booked, will be retained by the Jad. For longer stays 50% of the invoice amount will be retained, but at least 2 nights. For shorter stays any refund is excluded.
– Later cancellations: Any refund is excluded.
7. CANCELLATION B&B THE JAD
If an agreed advance payment is not made even after a reasonable grace period set by B&B the Jad has expired, B&B the Jad is entitled to withdraw from the contract.
Furthermore, B&B the Jad is entitled to withdraw from the contract extraordinarily for factually justified reasons, for example if:
– force majeure or other circumstances beyond the control of B&B the Jad make it impossible to fulfill the contract.
– rooms are booked under misleading or false information of essential facts, e.g. in the person of the customer or the purpose.
– B&B the Jad has reasonable grounds to believe that the use of the B&B service may jeopardize the smooth operation of the business, the safety or the public reputation of B&B the Jad, without this being attributable to the sphere of control or organization of B&B the Jad.
– There is a violation of the aforementioned clause 5.
In case of justified withdrawal by B&B the Jad, the contracting party shall not be entitled to any compensation.
8. BOOKINGS VIA TOUR OPERATORS
For bookings made through a tour operator, our General Terms and Conditions shall apply.
9. LIABILITY / DUTY OF CARE
The B&B room is to be used by the customer with the utmost care. The guest or contracting party is responsible for any damage incurred. B&B the Jad is only liable for intentional or grossly negligent contractual or non-contractual direct damages. Any further liability is excluded.
10. DATA PROTECTION
The Jad, Les Frasses 27, 2612 Cormoret is responsible for the collection, processing and use of your personal data and the compatibility of the data processing with the applicable data protection law.
Your trust is important to us, which is why we take the issue of data protection seriously and ensure appropriate security. It goes without saying that we comply with the legal provisions of the Federal Act on Data Protection (FADP), the Ordinance to the Federal Act on Data Protection (DPO), the Telecommunications Act (TCA) and other applicable data protection provisions of Swiss law.
11. FINAL PROVISIONS
In addition to the GTC, further provisions and booking conditions may apply, which take precedence over the GTC. Changes or additions to the accepted offer or these GTC should be made in writing. Unilateral changes or additions by the customer are invalid.
The place of performance and payment is the registered office of B&B the Jad.
Swiss law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In the event of a legal dispute, the place of jurisdiction shall be Berner Jura-Seeland.
Should individual provisions of these GTC be or become invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions shall apply.
